AMENDMENTS TO SECTION 8, 20060059 (N.D. 3-1-2006)


Amendments to Section 8, N.D.R.Proc.R., N.D. Sup. Ct. Admin. R. 14, 21, 35, 36, 37, and 44, N.D. Sup. Ct. Admin. Orders 7, 9, and 12, and Unified Judicial System Administrative Policies 106, 508, 510, and 513.

ORDER OF ADOPTION
The Supreme Court, on its own, considered amendments to Section 8, N.D.R.Proc.R., N.D. Sup. Ct. Admin.R. 14, 21, 35, 36, 37, and 44, N.D. Sup. Ct. Admin. Orders 7, 9, and 12, and Unified Judicial System Administrative Policies 106, 508, 510, and 513, implementing term limits of three consecutive three-year terms for committee members.

ORDERED, that the amendments to Section 8, N.D.R.Proc.R., N.D. Sup. Ct. Admin. R. 14, 21, 35, 36, 37, and 44, N.D. Sup. Ct. Admin. Orders 7, 9, and 12, and Unified Judicial System Administrative Policies 106, 508, 510, and 513, are ADOPTED effective April 1, 2006.

FURTHER ORDERED, that the term limit also applies to Supreme Court appointees to the State Bar Association’s Joint Civil Legal Services to the Poor Committee.

FURTHER ORDERED, that a member of the North Dakota State Board of Law Examiners is not eligible to serve more than two full consecutive terms. A former member who has served two full consecutive terms is eligible for reappointment after a six-year break in service.

I dissent. I believe this is a mistake, a “solution” in search of a problem. These rule changes would have denied the bench and bar the lengthy and invaluable committee service of members such as Professor Randy Lee on the Joint Committee on Attorney Standards and Professor Larry Kraft on the Joint Procedure Committee. Committees benefit both from experienced members and from “new blood.” Our committees have had both under our prior rules.
